At least not as they used to be

 The gap between rights and obligations:

Our understanding of “who is a child” has to change and needs to adapt itself to the realities of life today. There is a tremendous difference between our generation, what we were like as children and the new generation of children today. Of course there is also an enormous difference between one country and another. Here, I will be addressing only Israeli society.

Children in Israel mature at a very early stage in life. However, what they think is “mature” is not how we responsible adults perceive as mature . Children in Israel are given tremendous responsibilities in the army. For example, many command hundreds of other soldiers or they are made in charge of military equipment worth hundreds of millions of shekels.

We, the responsible adults are constantly trying to give children more freedom and independence to  prepare them properly for adulthood; so they can develop into self efficient, independent adults, with a healthy self esteem.

The problem is not with us, the responsible adults/parents, but  those “self called illuminated and liberal” parents. These parents are pushing the legislation to an extreme; where children have independence as adults but are not really asked to take any consistent responsibility for their own actions.

The Law:

The penal law in Israel (clause 361) deals with the crime (felony) of leaving a child without supervision.

The “Israeli State Penal Code” (In Hebrew “Hok Haonshin”) stipulates: Leaving a child under the age of 6 years old without proper supervision and thus as a result, endangering the child or hurting the child or in any situation that it might hurt (cause real harm to) him/her or his/her health, one shall be sentenced for three years imprisonment. If the crime was committed without intention (Negligence) – one year of imprisonment. If the crime was committed in order to abandon the child one shall be sentenced to five years imprisonment.

In the last discussion which took place on July 2011 (following a few others on 2006 and 2009) at the Committee of the rights of a child, child safety organization, the age of a child left unattended is aged 6 to 9 years old (this is prior to the requirement by law).

This is the law, and this is how our beloved members of parliament are kept busy with writing more laws. These laws should never have been written in the first place or at least should never be enforced.

How many of us would go to jail if this law was enforced? Who has ever needed to go out and  therefore left their children of different ages without “proper supervision”?

Fortunately, the law doesn’t provide any precise definition of “proper supervision” and as far as I know, the DA doesn’t indict anyone for leaving a child unattended as long as nothing extremely serious happens during this supervision.

There are several organizations dealing with the “well-being of children” (mostly formed by these enlightened-liberal group of parents)  among these different opinions they all suggest different ages for different situations. In short, the issue is left theoretical but not a practical issue, thus creating more committees and providing us the parents with nothing but more confusion.

Depending on the background (family, education, dwelling, religion etc) we can find “baby sitters” as young as 12 years old taking care of even toddlers. Our country is a mixed bag of different approaches such as the “Haredi” approach and the “ultra liberal” approach. These approaches are as different as night and day. There is no law that could ever narrow the gap between these extremely different and diverse ideas.

In the settlements for example, it is common for young children (even 12 years old) to babysit at nighttime . The religious family is more trusting of young children. They give children greater responsibilities such as letting them care for younger brothers and sisters.

Children are not as they used to be:

As we all know, our children are not as we used to be at their age. This new generation, is the first with total access to endless media, in addition to easy and free ways to gather information on any subject, such as sex, law and children’s rights.

Consequently, we are dealing  with a very knowledgeable generation with no emotional tools whatsoever to properly handle this knowledge. Parents are nursing their children to be completely dependent on them. Resulting, in an entire generation of children dependent on their parents for every step they make.

A 12 year old child today “thinks” he/she is an adult when in fact we are dealing with a child. On one hand we give them responsibility, expecting from them to perform as adults (leaving them alone at home all day because we are too busy building a career) but on the other hand every time they complain or cry “we jump to defend them”.

The solution:

There is no magic solution and no way to create laws regulating ages to do this or that. Those who think they can use legal tools to find solutions are utopians.

Negligence, no doubt,  is a crime. However, so far ,the enforcement of these unreasonable laws is done only seldom and in extreme cases.

Social Workers:

Unfortunately, some social workers have a problem interpreting the law. Some of them feel comfortable enough to threaten good and caring parents with legal sanctions because the parent “dared to leave” the child with an older brother or with a young babysitter.

If you feel threatened please contact a lawyer immediately and don’t feel obliged to answer to any of these accusations. They are at most nonsense and pure ignorance.

אחריות לחסרי ישע [א/228] (תיקון מס’ 17) תשמ”ג-1983

322. מי שעליו האחריות לאדם שמחמת גילו, מחלתו, ליקויו הרוחני, מעצרו או כל סיבה אחרת אינו יכול להפקיע עצמו מאותה אחריות ואינו יכול לספק לעצמו את צרכי חייו – בין שהאחריות מקורה בחוזה או בדין ובין שנוצרה מחמת מעשה כשר או אסור של האחראי – חובה עליו לספק לו את צרכי מחייתו ולדאוג לבריאותו, ויראוהו כמי שגרם לתוצאות שבאו על חייו או על בריאותו של האדם מחמת שלא קיים את חובתו האמורה.

 

חובת הורה או אחראי לקטין (תיקון מס’ 26) תש”ן-1989 (תיקון מס’ 56) תש”ס-2000 (תיקון מס’ 59) תשס”א-2001

323. הורה או מי שעליו האחריות לקטין בן ביתו, חובה עליו לספק לו את צרכי מחייתו, לדאוג לבריאותו ולמנוע התעללות בו, חבלה בגופו או פגיעה אחרת בשלומו ובבריאותו, ויראוהו כמי שגרם לתוצאות שבאו על חייו או על בריאותו של הקטין מחמת שלא קיים את חובתו האמורה.

השארת ילד בלא השגחה או במטרה לנטשו  (תיקון מס’ 59) תשס”א-2001

361. המשאיר ילד שטרם מלאו לו שש שנים בלא השגחה ראויה, ובכך מסכן את חיי הילד או פוגע או עלול לפגוע פגיעה ממשית בשלומו או בבריאותו, דינו – מאסר שלוש שנים; עשה כן ברשלנות, דינו – מאסר שנה; עשה כן במטרה לנטוש את הילד, דינו – מאסר חמש שנים.

 

הזנחת ילדים ומושגחים אחרים [א/185] [תשכ”ה] (תיקון מס’ 110) תשע”א-2011

362. (א)  בסעיף זה ובסעיף 363, “מושגח” –

(1)   קטין שלא מלאו לו שש עשרה שנים;

(2)   קטין שמלאו לו שש עשרה שנים או בגיר שאינם מסוגלים לדאוג לצורכי חייהם.

       (ב)  הורה של מושגח, אשר אינו מספק מזון, לבוש, צורכי לינה וצורכי חיים חיוניים אחרים במידה הדרושה לשמירת שלומו ובריאותו, דינו – מאסר שלוש שנים, זולת אם הוכיח שנקט אמצעים סבירים לפי הנסיבות להשגת הדרוש כדי לספק את הצרכים ואין בידו לספקם.

(ג)   המחויב על פי דין או הסכם לדאוג לצורכי חייו של קטין או של מי שאינו מסוגל לדאוג לצורכי חייו, הנתון להשגחתו, למעט הורה, אשר אינו מספק מזון, לבוש, צורכי לינה וצורכי חיים חיוניים אחרים במידה הדרושה לשמירת שלומו ובריאותו, דינו – מאסר שלוש שנים, זולת אם הוכיח שנקט אמצעים סבירים לפי הנסיבות להשגת הדרוש כדי לספק את הצרכים ואין בידו לספקם.

 

נטישת מושגחים [א/186] [תשכ”ה] (תיקון מס’ 110) תשע”א-2011

363. (א)  הורה של מושגח, שסירב לקבלו מידי מי שאינו מחויב לדאוג לצורכי חייו, או שהשאיר אותו בידי אדם שלא הסכים לדאוג לצורכי חייו, דינו – מאסר שישה חודשים; נטש את המושגח, דינו – מאסר שלוש שנים.

           (ב)  המחויב על פי דין או הסכם לדאוג לצורכי חייו של קטין או של מי שאינו מסוגל לדאוג לצורכי חייו, שסירב לקבלו מידי מי שאינו מחויב לדאוג לצורכי חייו, דינו – מאסר שישה חודשים; נטש את הקטין או את מי שאינו מסוגל לדאוג לצורכי חייו, דינו – מאסר שלוש שנים.
