If you are an immigrant and your spouse is Israeli and you have children and want a divorce, and want to move back to your country of origin… In most cases you can leave the country, but you cannot take your children with you without the permission of your spouse and sometimes from the social worker as well.
Separation of money, child support and visitation can be decided in either rabbinic or civil court based on where the case is first filed. If one spouse opens the case in civil court and the next day the other spouse opens a case in rabbinic court, the civil court rules – BUT you still need a GET from the rabbinic court.
You need a lawyer in civil court, in a rabbinic court you can go without a lawyer but you should still have a legal representative.
Using a mediator first – one who will help you and your spouse come to a legal agreement – can be the least painful and most cost effective method
